1. General Information

These Terms and Conditions ("Terms") govern the purchase of products from GrillzByIbra ("we", "us", "our"), an online retailer of custom decorative grillz jewelry. By placing an order, you ("the Customer") agree to be bound by these Terms in full. These Terms are governed by Italian law, in particular the Consumer Code (D.Lgs. 206/2005) and the Civil Code.

2. Nature of the Product

Our products are removable decorative accessories designed to be worn over the teeth for aesthetic purposes only. They are classified as fashion/costume jewelry under Italian and EU regulations. They are not intended to replace, restore, correct, or modify dental anatomy or any physiological function. They do not fall under the scope of EU Regulation 2017/745 on medical devices.

3. Not a Medical or Dental Service

GrillzByIbra is not a dental practice, dental laboratory, medical provider, or healthcare professional. We do not provide dental advice, dental treatments, or any form of medical consultation. We do not employ or contract licensed dentists, orthodontists, or dental technicians for the purpose of providing healthcare services. Dental impression kits provided are solely for the purpose of creating decorative jewelry and do not constitute a dental procedure. We strongly recommend that customers consult with a licensed dental professional before and after wearing any oral jewelry.

4. Assumption of Risk

By purchasing and using our products, the Customer acknowledges and accepts all risks associated with wearing decorative oral jewelry, including but not limited to:

• Irritation, discomfort, or allergic reactions to metals or materials
• Damage to teeth, enamel, gums, or existing dental work
• Choking hazard if the product becomes dislodged, particularly during sleep, eating, or physical activity
• Interference with speech, chewing, or other oral functions
• Any injury resulting from improper use, improper fit, or failure to follow care instructions

5. Dental Impressions

The Customer is solely responsible for the quality and accuracy of the dental impression provided, whether using our impression kit or a third-party impression. A poor-quality impression may result in a poorly fitting product. GrillzByIbra is not responsible for products made from inaccurate impressions. If a new impression is needed due to customer error, additional fees may apply. We recommend having dental impressions taken by a licensed dental professional for best results.

6. Orders and Payment

All orders are confirmed via email after submission. Payment is made via bank transfer to the IBAN provided in the order confirmation email. Orders are processed only after payment has been received and verified. Prices are in Euros (€) and include VAT where applicable. We reserve the right to refuse or cancel any order at our discretion.

7. Custom Products and Right of Withdrawal

Pursuant to Article 59, paragraph 1, letter c) of the Consumer Code (D.Lgs. 206/2005), the right of withdrawal does not apply to custom-made products or products clearly personalized. Since all grillz are custom-fabricated to the Customer’s dental impression, no refunds or returns are accepted on completed custom orders. If an order is cancelled before production begins, a partial refund may be issued at our discretion, minus any costs already incurred (impression kit, materials, etc.).

8. Limitation of Liability

To the maximum extent permitted by Italian law, GrillzByIbra shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our products. This includes, without limitation, any dental damage, oral injury, allergic reaction, choking incident, or any other harm that may occur from wearing, sleeping with, eating with, or otherwise using our grillz. Our maximum liability is limited to the purchase price of the product. The Customer agrees to indemnify and hold harmless GrillzByIbra from any claims, damages, or expenses arising from the misuse of our products.

9. Warranty

GrillzByIbra provides a warranty on material and manufacturing defects for a period of 30 days from delivery, in accordance with the legal guarantee of conformity under Articles 128-135 of the Consumer Code. This warranty covers defects in craftsmanship and materials but does not cover: damage caused by misuse, improper cleaning, or negligence; normal wear and tear; modifications made by the Customer or third parties; damage from wearing the product during sleep, eating, sports, or other activities not recommended. To make a warranty claim, contact us with your order number and photos of the defect.

10. User Responsibilities

The Customer agrees to: never sleep while wearing grillz; never eat or drink (except water) while wearing grillz; remove grillz before any physical activity or sports; clean grillz regularly following our care instructions; consult a dentist if any oral discomfort, pain, or injury occurs; keep grillz away from children and minors who are not supervised; not use grillz as a substitute for any dental treatment or appliance.

11. Age Requirement

You must be at least 18 years old to purchase products from GrillzByIbra. By placing an order, you confirm that you are at least 18 years of age. For customers under 18, parental or legal guardian consent and supervision is required.

12. Applicable Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Italian Republic. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Italian courts. For consumer disputes, the competent court is the court of the Consumer’s place of residence or domicile, in accordance with Article 66-bis of the Consumer Code. The Customer may also use the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
